Definition of personal data 

‘Personal data’ means all data that can be used to identify a natural person or make a natural person identifiable. These natural persons are referred to as ‘data subjects.’ For example, personal data may include: last name, first and middle name(s), telephone number, date of birth, e-mail address, zip code or IP address, information on a user account, username, order history, etc.  

When does M2DG collect my personal data? 

Personal data may be collected at any time during the reservation or ordering process (by phone, through a form, by sending an e-mail, etc.) but is also collected in the following situations: Requesting information, complaints and/or litigation, Sending information to third parties (deliveries, services, etc.) Accessing the M2DG site with cookies. When you browse through the site, it collects data about how you use the site (length of visit, IP address and pages visited), When you complete the contact form directly online on the site. Note that if you do not wish to share certain personal information about yourself, M2DG will not be able to provide information on the services it offers and will not be able to process your case. Why does M2DG collect my personal data? 

M2DG uses your personal data primarily for the following reasons: To be able to call you back and provide you with a personalized quote, M2DG uses a contact form to collect your personal data, To manage service orders and to perform the contract entered into with M2DG, M2DG needs to have access to various information about the client (contact information for billing, relevant details about the client). M2DG also collects data to provide personalized client support and manage client relationships by conducting satisfaction surveys, handling claims and providing after-sales services. Service order payments to M2DG may be made by wire transfer or check. Your payment data are not collected.  

How does M2DG share my data? 

M2DG may share personal data, for example when required by applicable law or legal proceedings, to respond to requests from public or government authorities or for the purposes of protecting its rights, seeking remedy or limiting the scope of damage. M2DG also shares your data with some of its processors and business partners, listed below. M2DG does however, ensure that these processors and business partners process the transferred data in accordance with personal data legislation.  

What is the legal basis for collecting and processing my data? 

Regulation protects individuals’ privacy, including their personal data. This means that your personal data cannot be used unless the data controller has a legal basis as provided for by regulation. M2DG has different legal bases for processing your data, depending on how the personal data are used. The applicable legal bases include: Performing a legal obligation: the law makes it obligatory to process your personal data, for example the obligation to store invoices. Performing a contract: processing personal data is necessary in order to perform a contract to which you have consented (processing or fulfilling an order for goods or services, opening an account for the client, etc.) Consent: you give “explicit” consent for your personal data to be processed (checking a box, clicking, etc.). Note that you may withdraw your consent at any time. When it is in the legitimate interest of M2DG: for example, to prevent fraud or for direct marketing. This legitimate interest may not, however, conflict with the rights and freedoms of the data subjects.

How long are my personal data stored? 

Most data are stored as long as you are an “active” customer and for a duration of 2 years after your last activity (for example, your last purchase). Your data are then archived with restricted access for an additional period for limited reasons authorized by law (payment, warranty, litigation, etc.). After this period, they are systematically deleted. Some data is subject to longer retention periods, often for regulatory reasons. For example, invoices will be retained for 10 years. Similarly, purchase orders or documents that may be needed for litigation will be retained for 5 years.  

Does M2DG transfer my data to third parties?

We have taken a series of organizational, technical and administrative measures, which are regularly reassessed, to maintain your personal data up to date and correct and to provide appropriate security for this data against any malicious hacking attempt or in cases of accidental loss, destruction or damage. These measures also include setting up a comprehensive physical security policy addressing security of the premises, equipment and system (secured access, secured passwords, etc.) When it goes through processors or business partners, M2DG ensures that they comply with personal data protection regulation.  

Updates to M2DG’s Privacy Policy 

This charter may be amended. Your rights under applicable legislation will not, of course, be affected. They may, however, be affected if the applicable legislation is amended. In the event of any changes, M2DG will inform you about the changes by e-mail or by notification directly on the site. M2DG ensures that no data are transferred outside of the European Union.  

What are my rights with regard to my personal data? 

You have the right: - to access, - to rectify, - to erase, - to object and restrict processing, As well as the right to data portability. You can also object for legitimate reasons to the use of your data, or without specifying a reason when your right to object is for the purpose of stopping all direct marketing. Lastly, you can set directives for retention, erasure and transfer of your data after your death. These directives may be general or specific.  

How can I exercise my rights and contact M2DG? 

To exercise your rights, you can contact the personal data protection officer by e-mail: contact@myflexoffice.fr or send a letter to M2DG, Service Clients, 40 Boulevard Magenta, 75010 Paris, stating your first and last name, e-mail and address and, if possible, your client reference/order number. In accordance with applicable regulation, any request to exercise your rights must be signed and accompanied by the photocopy of an identify card bearing your signature, and must specify the address where the response should be sent to you. A response will be sent to you within one month from the date the request is received.  

How can I contact the supervisory authority? 

If you believe that the response to your request is not satisfactory or if there is no response to your request, you also have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL), including through its website at www.cnil.fr.
